Scanwords 2.0 — End User License Agreement (EULA)

Effective date:

1. Parties

This End User License Agreement (the "EULA") is entered into between:

  • Licensor: Aleks Kalenov (Y3086983Y, address: Spain, Benidorm, Calle Derramador 10, 03503);
  • Licensee: the individual who installs and uses the mobile application Scanwords 2.0 (the "App").

2. Grant of license

2.1. Subject to the terms of this EULA, the Licensor grants the Licensee a non-exclusive, non-transferable, revocable license to install and use the App on devices owned or controlled by the Licensee.

2.2. The license is granted for an indefinite term (until terminated under section 6 or until the App is uninstalled).

2.3. Territory: worldwide, except where prohibited by applicable law.

2.4. The base license is free of charge. Optional paid content (coins, hints) is purchased separately through Apple In-App Purchase or Google Play Billing. All such purchases are subject to the respective platform's payment terms and refund policy. The Licensor has no control over and bears no responsibility for platform-side payment processing or refunds.

3. Restrictions

The Licensee shall not:

  • distribute, sublicense, rent, lease, or sell copies of the App;
  • modify, decompile, disassemble, or reverse-engineer the App, except as expressly permitted by law;
  • circumvent or disable any technical protection measures;
  • use the App for commercial purposes;
  • use the App in any manner not expressly permitted by this EULA.

4. Updates

4.1. The Licensor may provide updates automatically or at the Licensee's request, which may modify functionality, user interface, or fix defects.

4.2. Updates are provided under the terms of this EULA unless accompanied by a separate license.

5. Disclaimer and liability

5.1. The App is provided "as is" without warranties of any kind, express or implied.

5.2. The Licensor is not liable for:

  • incompatibility with specific devices;
  • damages directly or indirectly resulting from use of the App;
  • acts of third parties, including Apple and Google.

5.3. To the maximum extent permitted by law, the Licensor's aggregate liability is limited to the total amount paid by the Licensee for paid items in the App during the 12 months preceding the event giving rise to the claim.

5.4. Nothing in this EULA excludes liability that cannot be excluded under mandatory applicable law.

6. Termination

6.1. This EULA terminates:

  • upon uninstallation of the App;
  • immediately upon breach of this EULA by the Licensee;
  • by the Licensor with reasonable notice.

6.2. Upon termination, the Licensee shall cease using the App and delete all copies from their devices.

7. Distribution platforms

7.1. The App is distributed via Apple App Store and Google Play. The Licensee's relationship with these platforms is governed by the platforms' own terms:

  • Apple Media Services Terms and Conditions;
  • Google Play Terms of Service.

7.2. In case of conflict between the platform terms and this EULA, the platform terms prevail for matters of distribution and payments; this EULA prevails for use of the App.

8. Apple-specific terms

For iOS users, the following additional provisions apply:

  • This EULA is between you and the Licensor, not with Apple.
  • The Licensor, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to furnish maintenance or support for the App.
  • In the event of failure of the App to conform to any applicable warranty, you may notify Apple; Apple will refund the purchase price (if any), and Apple will have no other warranty obligation.
  • The Licensor is solely responsible for product claims, including product liability, non-conformance with law, and consumer protection.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Personal data

Processing of personal data is governed by the Privacy Policy available at: scanwords2.com/PRIVACY_POLICY.

10. Governing law

This EULA is governed by the laws of the Kingdom of Spain, without prejudice to mandatory consumer-protection laws of the Licensee's country of residence.
